Debt collection for utility payments through the court
When, with the beginning of a full-scale war, many Ukrainians were forced to leave their apartments, buildings managed by condominium associations or management companies faced the problem of accumulating debts for utility services. There is no minimum amount of debt that can be collected in court: the only question is expediency. After all, it is worth considering that the minimum court fee is 308 UAH.
The first way that most condominium associations usually take is to file an application for a court order to collect debt for housing and utility services. This procedure is quick (2-4 weeks), effective, and the application can be filed repeatedly. The disadvantage is that in the framework of injunctive proceedings, legal aid costs are not compensated.
Another way, which is used in case of disagreement of the defendant with the court decision, is the claim proceedings. On the one hand, this procedure is more complicated and longer, and on the other hand, it makes it possible to compensate for the costs of lawyer services.
