Extradition of developer Voitsekhovsky: is there a chance to achieve justice?
Fraud is the act of providing false information, concealing circumstances, or distorting reality for the purpose of obtaining a benefit.
Developer Anatoliy Voitsekhovsky, who defrauded investors of new buildings in Kyiv, returned to Ukraine in handcuffs and is currently in pretrial detention. Is there a chance for investors and owners of apartments in unfinished buildings to get their money back and what punishment will the developer receive, commented for Forbes managing partner of DE-JURE, lawyer Gryhorii Tripulskyi.
Voitsekhovsky’s return opens up the opportunity for victims to file a lawsuit in court. The penalty for fraud and creating a criminal organization is from 15 years in prison with confiscation of property. If Voitsekhovsky is found guilty, the court may also decide to recover funds in favor of the plaintiffs.
Yes, the developer’s property has already been confiscated, but there are chances of finding hidden funds in foreign banks and other companies associated with Voitsekhovsky, and if fraud is proven, it is also subject to confiscation.
Regarding the completion of the facilities, there was a similar situation in Odessa, when the developer “Progress-Stroy” left many unfinished buildings, and the city authorities completed them with budget funds and attracted private investors. However, the real estate market is currently skeptical about such a development.
