Appointment for consultation

to the lead lawyer

Tax law is a line of business of a law firm that helps prevent negative consequences when interacting with tax authorities or protect the client’s interests in a legal dispute with government authorities.

When we talk about tax practice, a lawyer may be needed in two cases: to prevent negative tax consequences (to help draw up a tax planning scheme, choose a tax regime, give advice on how the company will operate in the future, etc.), or to represent the interests of the company in court and administrative proceedings in the event of disputes with tax authorities. For example, when a tax audit has taken place and tax violations have been identified, lawyers become involved in the case. This is a complex task, and to solve it, they often involve their auditors or cooperate with the client’s financial director or accountant.

How does a tax law consultation work?

It is advisable to consult a tax lawyer in advance to prevent the problem from arising. During the first consultation, the business owner should provide information on how the company operates and pays taxes, or what the dispute with the tax service is about (for example, an unlawful fine). Ideally, the entrepreneur comes with an accountant. In most cases, one consultation is enough to understand the essence of the problem and think over a plan for further work.

The consultation can take place both online and offline – in the office of “DE-JURE” or the client, if the company’s staff is involved in the case. If necessary, “DE-JURE” connects a financier or other specialist to the work and organizes a joint meeting. The duration of the initial consultation is approximately one hour.

What documents should a client provide to receive advice on tax matters?

The documents that a client must provide depend on the nature of the problem. Many clients are individuals who have questions about confirming taxes. That is, a person has worked and saved money all his life, but has not filed a declaration and cannot confirm the source of income. Accordingly, there are difficulties in taking a loan from a bank, opening a company where authorized capital is involved, purchasing a car, etc.

A tax lawyer at “DE-JURE” raises all the documents of a person (company declaration, property rights, real estate documents, funds in the account, etc.) and sees them in the same way as a tax document. If some documents are missing, he will tell you how to get them and offer a solution. For example, when the client does not have money according to the documents and the property is registered in the name of his wife or husband, we can draw up a loan agreement from the husband (wife) to show the flow of funds.

Or a more complicated situation: a person has or had money in accounts in a foreign bank since the days when withdrawing funds abroad was legal. Now Ukrainians with significant amounts in accounts in foreign banks are faced with questions from the National Bank and the tax service regarding the origin of this money. The law firm”DE-JURE” helps in the analysis, structuring of income and auditing of documents confirming the presence of funds.

What results will it be possible to achieve with the help of a lawyer in tax legal relations?

The result of the help of a lawyer in tax legal relations is the solution of the client’s problem. Thus, in matters of legalization of funds, the client receives a document confirming their origin. The lawyer draws up a table showing the movement of funds and proves that they were all obtained legally.

If the client has applied for assistance in the scheme of operation of his enterprise, he receives appropriate advice and recommendations. In cases of tax audit, its act will be canceled.

What tax law issues do we help clients with?

The law firm “DE-JURE” provides assistance on all major tax law issues, including tax planning and forecasting, proving the origin of funds, and representing clients in tax disputes in administrative courts. Let’s consider examples of the main cases from tax practice that we often deal with.

Tax law consultation

Tax law consultation is a preventive measure that will help organize the work of the enterprise and draw up a taxation scheme in such a way as to avoid disputes with tax authorities and negative audit results in the future. Therefore, both entrepreneurs who are just planning to open their own business and those who are already working should periodically consult a tax law lawyer.

Tax planning assistance

There are many subtleties, features, and nuances in tax planning that a lawyer with the appropriate specialization, but not an ordinary person, understands perfectly. Sometimes the way the rules are written in the legislation and the everyday practice differ quite a lot. The law firm “DE-JURE” provides assistance in tax planning, because we have the necessary knowledge and experience.

Support of tax audits

The tax service, as a rule, notifies about the audit in advance. Therefore, while waiting for it, it is worth contacting a tax dispute lawyer, even if the client believes that there will be no problems. If it is a sudden audit of cash registers, the lawyer is connected after the tax service has made the purchase and checks the documents.

Representation in courts and tax authorities

We do not question the fact that taxes must be paid, and violations of tax legislation must be punished. However, in cases of imposition of unlawful fines by tax authorities, it is advisable to cooperate with a law firm in order to restore justice in a tax dispute and protect the rights of taxpayers.

Administrative appeal of tax notices and decisions

Another area of work for a tax dispute lawyer is the administrative appeal of tax notices and decisions. Tax authorities rarely change their decisions based on the results of an audit, but it can always be appealed, if not in this tax authority, then in an authority at a higher level or in court. A lawyer with significant practice in tax disputes, as a rule, understands well in which cases it is advisable to contact the tax authority, and when – to the court.

Proof of origin of funds

Lawyer assistance in tax matters is needed either before opening your own business, so that state authorities do not have any questions, or when a problem has already arisen – for example, a tax audit was unsuccessful. We urge legal entities and individuals to undergo regular audits. The principle here is the same as in the case of health checkups: it is better to prevent problems by identifying potential issues at an early stage than to resolve them promptly.

The law firm “DE-JURE” provides the following assistance in auditing the income and expenses of individuals:

  • support of reporting on a controlled foreign company (CFC);
  • initial identification of connections with non-resident companies;
  • support of the liquidation of CFC;
  • audit of assets of individuals and assistance in structuring taxes and expenses;
  • assistance in declaring income.

The law firm “DE-JURE” helps small, medium, and large businesses, and the price of an initial consultation is affordable for everyone.
