Land plots for development: an algorithm of actions for developers
At the beginning of the war, the activity of developers decreased somewhat, but in the end it became obvious: the need for quality housing and developed infrastructure has not disappeared. However, in the conditions of 2025, the risks are much higher, so the priority is the security of the transaction and the speed of construction work.
The law firm “DE-JURE” has been successfully supporting developers at all stages of work for many years – from the purchase of a land plot to the sale of apartments in a new building. This is proven by our position in the rating of leading law firms in Ukraine from “Yurydichna Gazeta”.
Head of the real estate and construction practice of the law firm “DE-JURE”, lawyer, candidate of legal sciences Ivan Topor offers developers a simple algorithm of actions that will lead to the safe purchase of a land plot for development.
- Determine the intended purpose of the land plot. To do this, you will need an extract from the state land cadastre. Urban planning documentation (general plan and detailed plan of the territory) will help you understand what structures and at what density you can build on this site, sometimes you also need to familiarize yourself with urban planning conditions and restrictions. It is also important to check the availability of engineering networks (electricity, sewage, gas supply) and calculate the cost of their connection.
- Conduct a legal inspection of the land plot and determine the presence of risks (restrictions, land being under arrest, easements, etc.) – you can try to do this yourself, but it is more advisable to order legal support from professionals.
- Choose a convenient way to acquire land: lease, purchase or land auction. Each of these options has its own advantages and disadvantages.
- Order a technical inspection from land managers or surveyors. They determine the risks associated with the composition of the soil, as well as the passage of engineering networks that are not included in the easement underground.
A comprehensive inspection of the site before purchase means safe construction and the absence of litigation.
