War damages: who gets them and how?
War damage is the loss or damage to property, health or life resulting from an armed conflict. The determination and compensation of such damage are carried out according to special procedures.
The real amount of damage from the war can hardly be calculated right now, while Russia continues to destroy our country. According to experts, we are already talking about damage in the trillions of dollars. The law firm “DE-JURE” is working to ensure that the issue of compensation for losses to Ukraine, despite the flurry of news, remains on the agenda.
Recently, the managing partner of “DE-JURE” , candidate of legal sciences Gryhorii Tripulskyi, and the partner of “DE-JURE” , lawyer Artem Ripenko, wrote an article about what mechanisms for compensating for losses from the war are available to the state, private individuals and business, for the publication “Legal Practice”.
Since we are talking about aggression by a nuclear state with the right of veto in the UN Security Council, it is currently impossible to force Russia to pay reparations to Ukraine. Therefore, the Council of Europe has created a Register of Damages for Ukraine, while the work of the international compensation commission and fund is ongoing. Unfortunately, the issue of paying reparations from Russia’s assets abroad is currently hanging in the air.
If international collective redress mechanisms are primarily aimed at compensating for losses of individuals (including in Ukraine), then business finds itself in the most difficult situation. Many enterprises have been destroyed, remained in occupied territories or ceased their work. Since compensation for business is not a priority of international compensation mechanisms, alternative methods have to be sought, such as international arbitration. However, the enforcement of its decision is not always possible.
