The Military Medical Commission (MMC) ignores the real state of health: what to do?

The decision regarding the mobilization of the military-medicine commission (MMC) was made even quickly and without addressing health problems, which gives the right to serve in the military or as a base for military service. Disability, it is possible and necessary to disqualify this restoration. Before any actions are taken, the lawyer Yuriy Kostinyuk, the lawyer of the ship practice of the law company “DE-JURE”, has revealed.

It is possible to rescind the MMC document regarding affiliation before service either by submitting the sack to the MMC of a higher level, or in court. In both cases, however, it is necessary to prepare evidence: statements, epicrises, treatment results, doctor’s notes and other medical documents that confirm the presence of health problems. It is important that these documents are submitted by doctors of state or municipal medical institutions, and they themselves are given priority when reviewing the revision of the MMC of the highest level (regional, regional or central – depending on whose revision will be disgraced). To apply for a MMC renewal, you must write an application in the correct form and attach copies of medical documents to it.

For the results of looking at the skarga of the MMC of the highest level, it either means a repeated look at the evidence of evidence of health problems, or it is necessary to edit the vidmova with a satisfied skarga.

If you wanted to disqualify the MMC in court order, you must submit a petition to the administrative court for the place of residence or the place of residence of the MMC for 6 months from the revocation of the MMC. The document itself is submitted simultaneously with a written application and collected evidence. It is important to note that the court does not verify the compliance of the person with the criteria of ineligibility, but rather verifies the pre-existing MMC order of carrying out all necessary procedures. If an injury is detected before the medical examination is completed, the court orders the MMC to conduct a new examination.
