How to resign from service due to health reasons?
Discharge from service is the termination of military duties by a person serving. It can be due to health, age, family circumstances, or upon completion of a contract.
You can resign from the Armed Forces due to health reasons if the Military Medical Council issues a conclusion on permanent or temporary unfitness for military service, as well as if you become disabled. But this does not happen automatically – the serviceman must submit a report on his desire to resign and provide all the necessary documents. The specialists of the “DE-JURE” law firm know how to do this.
According to the lawyer of “DE-JURE” Larisa Kis, even if the report is not approved by the immediate commander, this does not prevent it from being considered by a higher-level official who makes the appropriate decisions. The report, signed using an electronic signature, can be sent to the e-mail of the military unit. Servicemen who have a conclusion of the Military Medical Council must be dismissed no later than 3 months after submitting the report.
If the VLK does not want to write off a person who has the necessary indications, the only thing left to do is to appeal the VLK’s decision and request either a new examination (if the conclusion indicates a different diagnosis), or a review.
